Terms of Use — Dead Sets

These Terms of Use ("Terms") govern your use of the Dead Sets iOS application ("the app"). By downloading or using the app you agree to these Terms. If you do not agree, do not use the app.

1. The service

Dead Sets lets you browse and search historical Grateful Dead concert setlists. An optional auto-renewing subscription, Dead Head Chat, provides access to an AI chat assistant that answers questions about setlist history.

2. Subscription terms

• Dead Head Chat costs $1.99 per month (price may vary by region) and includes a 7-day free trial for new subscribers.
• The subscription includes up to 30 chat messages per day; the daily allowance resets each day and upon billing renewal.
• Payment is charged to your Apple Account at confirmation of purchase, or at the end of the free trial unless cancelled at least 24 hours before the trial ends.
• The subscription renews automatically each month unless auto-renew is turned off at least 24 hours before the end of the current period. Manage or cancel it anytime in your Apple Account's Subscriptions settings.
• Refunds are handled by Apple under its media services terms; we cannot issue refunds directly.

3. AI-generated content

Dead Head Chat responses are generated by an artificial-intelligence model. Responses may be inaccurate, incomplete, or outdated, and are provided for entertainment and informational purposes only. Verify important facts independently.

4. Acceptable use

You agree not to abuse, disrupt, reverse engineer, or attempt to gain unauthorized access to the app or its backend services, and not to use automated means to exceed usage limits.

5. Intellectual property; no affiliation

The app's software and design are owned by its developer. Setlist data is derived from publicly available historical records. Dead Sets is an independent fan project and is not affiliated with, endorsed by, or sponsored by the Grateful Dead, its members, or their affiliated entities. All band names and trademarks belong to their respective owners.

6. Disclaimer of warranties

The app is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability.

7. Limitation of liability

To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app. Total liability for any claim shall not exceed the amount you paid for the service in the twelve months preceding the claim.

8. Changes to the service or these Terms

We may modify or discontinue features, limits, or pricing, and may update these Terms. Continued use of the app after changes take effect constitutes acceptance. Material changes will be reflected by an updated effective date on this page.

9. Governing law

These Terms are governed by the laws of the United States and the state of the developer's residence, without regard to conflict-of-law principles.
